Terms of Service

1. Agreement

By accessing or using Albumly (“the Service”), operated by Layered Groups (“we”, “us”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. The Service

Albumly is a photography studio management platform that allows photographers to upload photos, share galleries with clients, collect client feedback, and build albums. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. Accounts

• You must be at least 18 years old to create an account.
• You are responsible for maintaining the security of your account credentials.
• You must provide accurate information when signing up.
• One person or business entity may not maintain more than one free trial account.
• We reserve the right to suspend or terminate accounts that violate these terms.

4. Acceptable use

You agree not to use Albumly to:

• Upload or share content that is illegal, harmful, abusive, or infringes third-party rights.
• Upload content that violates any person’s privacy without their consent.
• Attempt to reverse-engineer, scrape, or interfere with the Service.
• Use the Service for any purpose other than legitimate photography business use.

5. Your content

You retain full ownership of all photos and content you upload to Albumly. By uploading content, you grant us a limited licence to store, process, and display it solely to provide the Service to you. We do not claim ownership of your content and do not use it for any purpose beyond operating the platform.

6. Subscription and billing

• Albumly offers a 14-day free trial. No credit card is required to start.
• Paid plans are billed monthly or annually as chosen at checkout.
• Payments are processed securely by Stripe.
• You may cancel your subscription at any time. Access continues until the end of the current billing period.
• We do not offer refunds for partial billing periods unless required by law.

7. Data and privacy

Our use of your personal data is governed by our Privacy Policy, which forms part of these Terms.

8. Intellectual property

The Albumly name, logo, design, and software are the intellectual property of Layered Groups. You may not copy, reproduce, or use them without our written permission.

9. Disclaimer of warranties

The Service is provided “as is” without warranties of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or meet your specific requirements. Use the Service at your own risk.

10. Limitation of liability

To the maximum extent permitted by law, Layered Groups shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including loss of data, loss of revenue, or loss of business opportunity.

11. Termination

You may delete your account at any time. We may suspend or terminate your account if you violate these Terms. Upon termination, your data will be retained for 30 days before deletion, giving you the opportunity to export it.

12. Governing law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
